Fair Labor Standards Act (FLSA) Information for NMSU
On April 23, 2024, the Department of Labor (DOL) released a final rule revising the Fair Labor Standards Act’s (FLSA’s) regulations regarding the salary threshold to be exempt from getting paid overtime under the Executive, Administrative, and Professional exemptions. Effective January 1, 2025 the FLSA’s annual salary-level threshold for exemptions to overtime requirements will increase from $43,888 to $58,656. The standard salary level will equal $1,128 per week and Highly Compensated Employees' (HCE) total annual compensation level will equal $151,164. While it is possible Court challenges could block the rule, the rule proposes updates every three years.
Human Resources will continue to work with university leadership and departments to help ensure we fully comply with these new regulations and evaluate the impact on university positions. We will communicate with the proper stakeholders regarding any changes that impact employees associated with the AFSCME collective bargaining agreement.
As the evaluation provides answers, we will provide additional information and communicate the outcome to the impacted employees and their direct supervisors.
